I’ve been on a bit of a roll lately, blogging daily. That’s not a goal, but I’ve just stumbled into it.

I’m going to try to separate any blogging about Florida Man into separate posts. If we are lucky, he’ll continue fading from memory and relevance anyway. Today is not a day when I write about him.

My (Other) Man Mitch

I’ve long been an admirer of outgoing Purdue President Mitch Daniels, who adopted Dubya’s praise of “my man Mitch” and made it his own when he ran for Governor of Indiana.

But I also respect the heck out of Mitch McConnell, and am pleased that Senate Republicans spared no time re-electing him as their leader over a Trumpier challenger.

McConnell is shrewd, stable, and flexible. He cooperated with Trump a lot without becoming a sycophant. He also criticized Trump without becoming an unhinged never-Trumper, and that even in the face of Trump’s racist attacks on his asian wife. He carefully assesses electability when parsing out dollars to candidates from funds he effectively controls, and I have little doubt that the Republicans would have a majority in the Senate come January if primary voters had picked his preferred candidates over Trump’s parade of grotesques.

In other words, he’s a grown-up in a city of petulant, limelight-seeking adolescent Republicans and soccer-flopping progressives.

Democrats like to demonize McConnell as Republicans demonize Nancy Pelosi and Chuck Schumer, but we’d put an end to the “do-nothing Congress” if we had more Senators and Representatives of his temperament and experience.

What does he know, anyway?

Reacting to an uncommonly silly pronouncement from Peter Thiel:

Wait. What? The three options for the liberal democracies of Western Europe are Sharia law, “Chinese communist AI,” and some kind of green energy state? And there are “no other doors?” The only thing that separates that comment from a light-night, weed-infused dorm room bull session is his few billion dollars. That’s the person who should reshape the GOP? 

I’ve come to your inbox less to condemn the gurus (though people who commit fraud should pay the price), but to ask a different question. Why do we fall for them time and again?

I’m not someone who tells celebrities to “shut up and sing” or athletes to “shut up and dribble.” And I’d never tell Elon Musk to “shut up and get to Mars” or tell Peter Thiel, “shut up and facilitate cashless transactions.” I like the marketplace of ideas. I’m open to interesting thoughts from unlikely sources. 

But I object to the presumption of insight from famous or successful people. I object to the hero worship (or greed) I’ve seen with my own eyes, where sycophants and fans won’t tell the wealthy and famous obvious truths because they hope to bask in their reflected glory or benefit from their largesse.

David French, America, Can We Talk About Our Guru Problem?

It used to be stars and starlots on whose every oracular word we waited. Now it’s billionaires, more than one of whose bubbles could turn them into mere millionaires by tomorrow.

Blake Masters

Speaking of Peter Thiel, the George Soros of the Right (and neither of those two is as dumb or evil as their detractors think), one of his boys, Blake Masters, lost in Arizona.

I don’t need to have, and don’t have, an overall impression of Masters. But I’ve got some litmus tests and one of them is “if a candidate quotes the late Sam Francis without caveats, don’t vote for him.”

Francis was brilliant, atheist, and deeply racist. I appreciated his brilliance until his racism became undeniable, and it is why he should be “consigned to the dustbin of history.”

Federalist Society at a Crossroad

Peter Cannelos thinks the Federalist Society was all about reversing Roe v. Wade and is adrift now. (“You get your white whale and what do you do? What’s the next thing?”)

“Not so fast,” say David French and Sarah Isgur on Thursday’s Advisory Opinions podcast. That was never the purpose of the Society and its actual purpose remains vital. The real question is whether the Society will stand by its principles when populist Republicans, not liberals or progressives, are the ones trampling on the Constitution, as the Society has become closely identified with the GOP and the GOP has become performatively populist at the state level in particular.

David and Sarah seem to think FedSoc will stand by its principles initially, but that losing its “conservative” friends when it does so will intensify long-term pressure to forsake principle for politics. It’s the nature of those long-term pressures that make Cannelos’s piece worth reading. And he’s not necessarily wrong that abortion is what FedSoc was about in public impression.

EA

Although SBF and the collapse of FTX have cast a pall over EA, that’s unwarranted.

We really should think about how much our charitable giving actually helps, not about how virtuous it makes us feel. That doesn’t mean we all should suddenly start giving only to deploy mosquito nets against malaria, but:

Michael Gerson, RIP

Still, Gerson deserves high marks for his criticism of Donald Trump and, above all, for his readiness to call out fellow evangelicals for their abject obeisance. The day after the assault on the Capitol, he wrote a column holding them more responsible than anyone else for “unleashing insurrectionists and domestic terrorists.”

I come back to this group repeatedly, not only because I share an evangelical background and resent those who dishonor it, but because the overwhelming support of evangelicals is the single largest reason that Trump possesses power in the first place. It was their malignant approach to politics that forced our country into its current nightmare. As white nationalists, conspiracy theorists, misogynists, anarchists, criminals and terrorists took hold of the Republican Party, many evangelicals blessed it under the banner “Jesus Saves.”

Nor did he hesitate to name names: Franklin Graham, Jerry Falwell Jr., Robert Jeffress, Ralph Reed, Penny Nance.

Mark Silk, Two cheers for Michael Gerson

Gerson’s reasons for coming back to evangelicals in the Trumposene were closely akin to my reasons.

For what it’s worth, I don’t share Silk’s condemnation of him for his role in selling the Iraq war. I voted for Bush’s “humbler foreign policy” in 2000, but I understood on 9/11 that the pressure for a strong military response against someone-or-other was going to prevail, and better people than I backed it at the time. I don’t think I ever supported the war (God forgive me if I did), but relentless resistance was futile.

Remembering our collective sins

He asked me if I had been to Auschwitz, in Poland. I hadn’t. “Don’t go there,” he said, shaking his head. “People are all with their phones. It should be prevented. And they go”—he raised his hand a few feet from his face and looked at his palm, emulating someone taking a selfie—“ ‘Me in front of the crematorium.’ ‘Me in front of the ramp.’ I mean, it’s so obscene.”

In the United States there are 41 million Black people; we make up 12.5 percent of the population. In Germany, there are approximately 120,000 Jewish people, out of a population of more than 80 million. They represent less than a quarter of 1 percent of the population. More Jewish people live in Boston than in all of Germany. (Today, many Jews in Germany are immigrants from the former Soviet Union and their descendants.) Lots of Germans do not personally know a Jewish person.

This is part of the reason, Steiner believes, that Germany is able to make Holocaust remembrance a prominent part of national life; Jewish people are a historical abstraction more than they are actual people. In the United States, there are still millions of Black people. You cannot simply build some monuments, lay down some wreaths each year, and apologize for what happened without seeing the manifestation of those past actions in the inequality between Black and white people all around you.

Steiner also believes that the small number of Jewish people who do reside in Germany exist in the collective imagination less as people, and more as empty canvases upon which Germans can paint their repentance.

The story was so long that I almost didn’t read it, despite some trusted person’s recommendation. I’m glad I did. It brought tears to my eyes in places.

The explicit challenge is “how will America remember its sins?”, but that feels like an afterthought, to add a touch of “relevance,” and few answers are suggested.

Reminder to self

I’ve been seeing a lot of accusations lately that various conservatives are white supremacists, or, somewhat more narrowly, that they are adherents of "white replacement theory." My initial reaction was to treat this as a way of mainstream media saying that conservatives have cooties.

But when it comes to white replacement theory, there’s a very important line: it is on one side of the line to think that there is a conspiracy to replace white people with darker skinned people, and that the southern border (for instance) has been thrown open by the Democrats as part of that conspiracy. It is on the other side of the line to note that much of our immigration is darker-skinned people, and that white folks have sub-replacement fertility levels, and that as a matter of fact we are on track for white people to be outnumbered by the year 2050 — without carrying on luridly about how that, ipso facto, will be "the end of America.”

My personal history of dismissing warnings too casually is cautionary. I was slow to see that the charges of anti-Semitism against conservative columnists Joseph Sobran and Samuel Francis were not just epithets thrown by liberals, but true. (Both were brilliant, but both really were antisemitic, though Sobran at least wrote a lot that was not tinged with antisemitism.) I was also slow to see that Patrick J. Buchanan was coming unhinged, as I think he was (and is).

So in dealing with charges of white replacement theory, and giving due allowance to the possibility that somebody like Tucker Carlson is insincerely talking about it just to attract viewers, I need to be aware that even if the comments, prima facie, fall on the right side of the afore-described line, bringing the subject up obsessively is a very bad sign. That’s what should have tipped me off earlier on Sobran.

Meatloaf on side constraints

The Federalist Society is committed to advancing the rule of law, which is why many of its members, in their individual capacities, have worked so hard for the appointment of judges who believe in the rule of law. And many of those judges, in ruling against meritless election challenges brought by the man who appointed them, stood up for the rule of law in the past few months, to their great credit.

But to sacrifice the rule of law as a value, in the hope of getting four more years of a president who might appoint good judges but is otherwise anathema to the rule of law (sic), is simply perverse. I am the last person to underestimate the importance of judges, but if you will allow me to close by paraphrasing Meatloaf, here is my bottom line:

“I would do anything for judges — but I won’t do that.”

David Lat, ‌The Federalist Society And The Capitol Attack: What Is To Be Done?. Lat was commenting in the second paragraph on some individual Federalist Society members. The Society itself cannot lawfully back a candidate, nor did it do so unlawfully.

On choosing to cease choosing

[H]uman flourishing depends, [Antonio García Martínez] says, on the acceptance of various "unchosen obligations" (to family, to community, to God) that form the backdrop of a morally and spiritually satisfying life. Hence his attraction to Judaism, an ancient, communally based system of laws that seems far more secure than our confusingly fluid world of freely choosing individuals.

Which means that García Martínez is converting to Judaism in order to escape secular modernity — but isn’t his own decision to convert itself an individual choice? And as such, isn’t it just as much an expression of the modern mindset as any of the trends he denounces here and in his broader social media commentary?

Yes, it’s a choice to stop choosing, but that still grounds his conversion in an act of the individual mind and will. García Martínez will always know that what can be chosen can also be unchosen — that he can choose to leave Judaism with an ease that would have felt quite foreign to a premodern Jew.

This doesn’t mean that García Martínez is making a mistake in becoming Jewish. (I have my own complicted history with Judaism, Catholicism, and conversion.) But it does mean that doing so isn’t likely to liberate him from modernity, returning him to the premodern world as conservatives like to imagine it — a world defined by fated obligations individuals have no choice but to take on and accept with gratitude and fulfillment.

Choosing is the destiny of human beings, from which we will never be rescued.

I wish Antonio García Martínez were choosing Orthodox Christianity instead of Judaism, but I had the same types of taunts tossed at me as I approached Orthodoxy: "So, you’re choosing to stop choosing, huh?! Har-de-har-har-har!"

I gotta live in the world as it is. In American law and the American mind, one’s church is a "voluntary association." You can opt in; you can opt out. Nobody can stop you legally and few will try socially*. But I can choose wisely and resolve to let the faith, in that chosen setting, do its work on me, not looking for greener grass elsewhere.

Or looking for sheer novelty, as if it doesn’t matter:

To assert that all religions are really just different paths to God is a denial of the central tenets of these religions. The Hindu Yogin trying to achieve oblivion and utter absorption into the faceless universe is not on the same path as the Jew bowing down before the God of Abraham, Isaac, and Jacob, or the Scientologist working to become “clear” of alien beings called “thetans.” To suggest that all these believers are really on the same path is to do damage to their theological systems—to assert that somehow we know better than these people do what their teachings really are.

I just can’t figure this out

New York Times’s criteria for considering a story religious continue to baffle. Why, for instance, is a call for blessing same-sex couples, from German Bishops in the Roman Catholic Church, not there?! It clearly is a religion story and it even flatters the Times’ notion of how arc of history is bending!

My, we are hard to please!

One accusation against Christianity was that it prevented men, by morbid tears and terrors, from seeking joy and liberty in the bosom of Nature. But another accusation was that it comforted men with a fictitious providence, and put them in a pink-and-white nursery. One great agnostic asked why Nature was not beautiful enough, and why it was hard to be free. Another great agnostic objected that Christian optimism, “the garment of make-believe woven by pious hands,” hid from us the fact that Nature was ugly, and that it was impossible to be free. One rationalist had hardly done calling Christianity a nightmare before another began to call it a fool’s paradise.

The surge doesn’t exist, and it exists because Republicans are adding testosterone to our public water supplies to try to shore up the Eurocentric Heteronormative Patriarchy, and the one in 20 were there all along, but just too embarrassed to say it. Yeah! That’s the ticket!

I grow weary of the Covid discourse. So, so weary. I am particularly exhausted by the fact that the side that is more correct on the epidemiology, the pro-vaccine side, is also worshipful of expertise, incurious about basic questions, contemptuous of good-faith questions, and shrill in all things. I hate it all.

Practicing silence

Sit in silence 20 to 30 minutes each day, not to become more "productive", but to become more human and, ultimately, more Christlike.

This is advice to myself.

Silence?! 20-30 minutes of silence!? It’s so terrifying that I must try it.

UPDATE: A 300- knot prayer rope helps. I couldn’t imagine remaining silent for that long without my scattered mind going hither, thither and yon. But the same faith that (through one of its wise priests) counseled sitting in silence 20 to 30 minutes each day knows how to do that: repetitive prayer — not, I hasten to add, that God will hear me because of repetition, but that my heart (and who knows what else) will be changed by it.

The nice thing about this gigantic rope is that praying the full rope takes me about 21 minutes, and if I add another hundred knots (to the first bead, which is a tactile clue) I’m at almost 28 minutes. I don’t have to try to remember how many times I’ve prayed a 50-knot rope — which is itself a distraction from "silence."

Calling spades “spades”

Four snippets over the past few days (several of the articles are months old, though) from people who were taking no guff.

From New York Magazine last November, on turmoil at the New York Times:

Twitter presented innumerable headaches, with reporters having to be chastised for being overtly political, or simply for sounding un-Timesian in their pursuit of likes and retweets. “There’s a very sad need for validation,” one Times journalist who has tweeted tens of thousands of times told me.

Some of the trickiest jounalistic questions have centered on what the Times is or isn’t willing to say. After [James] Bennet’s ouster, [A.G.] Sulzberger met with a columnist for the “Opinion” section who had expressed consternation about the decision. Sulzberger promised the columnist that the Times would not shy away from publishing pieces to which the Times’ core audience might object. “We haven’t lost our nerve,” Sulzberger said.

“Yes, you have,” the columnist told Sulzberger. “You lost your nerve in the most explicit way I’ve ever seen anyone lose their nerve. You can say people are still gonna be able to do controversial work, but I’m not gonna be the first to try. You don’t know what you’ll be able to do, because you are not in charge of this publication — Twitter is. As long as Twitter is editing this bitch, you cannot promise me anything.”

I had forgotten this prophesy:

Let us not hedge about one thing. Donald Trump may win or lose, but he will never concede. Not under any circumstance. Not during the Interregnum and not afterward. If compelled in the end to vacate his office, Trump will insist from exile, as long as he draws breath, that the contest was rigged.

Trump’s invincible commitment to this stance will be the most important fact about the coming Interregnum. It will deform the proceedings from beginning to end. We have not experienced anything like it before.

Maybe you hesitate. Is it a fact that if Trump loses, he will reject defeat, come what may? Do we know that? Technically, you feel obliged to point out, the proposition is framed in the future conditional, and prophecy is no man’s gift, and so forth. With all due respect, that is pettifoggery. We know this man. We cannot afford to pretend.

Successful Substack writers continues to evoke envy, which tends to get expressed (in writing inferior to the Substack average) as addlepated moral outrage. Marxist blogger-turned-Substacker Freddie de Boer has had lots of thoughts about that, culminating most recently in this:

I write tens of thousands of words on topics ranging from why everyone is actually exhausted to The Giving Tree to the Nation of Islam to Instagram feminism to the charter school scam to atheism after the New Atheists (coming Monday!). Don’t like it? Write better shit, man. Or get mad online. It’s up to you. My people will support me, and I earned that.

What are you, 12? There’s no “deserves”


I hadn’t thought about the implications of some prominent Federalist Society members being implicated in the January 6 insurrection. But David Lat had thought about it quite a lot in the two weeks after:

The Federalist Society is a nonpartisan organization that does not — and cannot, as a 501(c)(3) nonprofit — endorse candidates for elective public office. It therefore has no official relationship with Donald Trump …

Unfortunately — and quite reprehensibly — several prominent FedSoc figures played roles in Trump’s baseless challenge to the 2020 election results, and therefore bear significant blame for the Capitol attack. Law professor John Eastman — chair of FedSoc’s Federalism and Separation of Powers practice group, and a frequent participant in Society events over the years — represented Trump in his (meritless and unsuccessful) attempt to get the Supreme Court to intervene in the election, urged Vice President Mike Pence to overturn the election results, and had a prominent speaking role at the rally that was the precursor to the riots. Senator Josh Hawley (R-Mo.) and Senator Ted Cruz (R-Tex.), two members of what conservative law professor John O. McGinnis once dubbed “the Federalist Society caucus” … led the charge in the Senate against certification of the election results, just hours after the horrific Capitol attack. In light of all this, a reckoning at the Federalist Society is in order.

So what should FedSoc do in the wake of the Capitol riots? …

First, and most obviously, the Society should no longer allow John Eastman, a prominent promoter of poisonous conspiracy theories about the election, to remain in leadership, as chair of the Federalism and Separation of Powers practice group …

Second, the Society should no longer host events with Eastman, Hawley, and Cruz …

Third, as a more general matter, the Federalist Society should try harder to steer clear of partisan politics. It should be non-partisan not just in name, but in spirit.

Of course, the larger and longer-term issue, not just for the Federalist Society but for conservatives, libertarians, and Republicans, is how much of their principles they are willing to sacrifice for power.  Allying themselves with Donald Trump for four years got them tax reform, three Supreme Court seats, more than 200 lower-court judgeships, and all sorts of other goodies. But was it worth it?

… I am the last person to underestimate the importance of judges, but if you will allow me to close by paraphrasing Meatloaf, here is my bottom line:

“I would do anything for judges — but I won’t do that.”

My admittedly unscientific sample of a dozen Federalists’ personal stories — backed up by political scientists’ more systematic research into the question — suggests that each individual Federalist is akin to an excited synapse in a sprawling hive mind with no one actually in charge.

The society itself lobbies for no policies; it never signs amicus briefs or represents clients in cases. No one at Federalist Society headquarters in Washington dictated Barnett’s moves or told him how to advocate for what positions. It’s just that at a few gatherings made possible by the Federalist Society that Barnett happened to attend, synapses fired, a corner of the hive mind engaged, and Barnett took it from there. Multiply that chemistry tens of thousands of times over the past 36 years and you have the Federalist Society’s true source of power.

Trump’s Terrible Record on Property Rights. That a sleazy land developer should think stealing from widows and orphans is a great idea comes as no surprise.

Love or hate him (or anything in between), no reasonable person can deny that Trump is a textbook example of narcissistic personality disorder. Reading the list of symptoms on the Mayo Clinic’s website is like scrolling through the president’s Twitter: “Require constant, excessive admiration,” “exaggerate achievements and talents,” “be preoccupied with . . . brilliance, beauty or the perfect mate,” “monopolize conversations and belittle . . . people,” “expect special favors and unquestioning compliance,” “have an inability or unwillingness to recognize the needs and feelings of others.”

If we are stressed, we can talk ourselves into believing we are relaxed, but our jaw may be tight and our brow heavy. In the same way we sometimes mistake ‘correct doctrine’ for love, and wonder why we feel so angry when our doctrines are attacked. In the image, the little figures are ‘every man’ and ‘every woman’. They are lost in the present moment, and the only government is the beauty of the silent tree around which, with all their hearts, they dance.

Conde Nast has tried slipping a morality clause into contract with writers:

granting Condé Nast, the New Yorker’s corporate overlord, “sole authority” to terminate writers’ contracts in the event they become the focus of a social-media mob, “the subject of public disrepute, contempt, complaints or scandals.” The morality clauses are now regular features of writers’ contracts at Condé Nast.

… Two things are almost always misunderstood about these campaigns: One is that the Twitter mobs are mostly camouflage for internal corporate politics — ABC is not making multi-million-dollar programming decisions based on the tweets of Caitlyn the Rage-Monkey on Twitter, but public outcries can provide plausible pretexts to internal plotters. Second, the institutions themselves — corporations, publications, government agencies — are the real target, not the writers or other contributors. The point of the Bret Stephens mob wasn’t to silence Bret Stephens, who has any number of places he can publish that will give him an audience comparable in size and prestige to that of the New York Times; the point of the Bret Stephens mob was for status-anxious and resentful nobodies to get a momentary jolt out of telling the New York Times “Dance, monkey!” and seeing its editors begin to tap their feet and sway.

One wonders what kind of magazine writer is not involved in public disputes, and what use he could be.
