The Surprising Truth About Handmaids

The heart of Gilead is not religious extremism, but social engineering.

Nowhere is this more apparent than in the Handmaids themselves, and the Ceremony that defines their role. The idea that women can be used outside of the confines of marriage as incubators for strongly desired children would be abhorrent to the vast majority of religious conservatives who seem to be The Handmaid’s Tale‘s targets. But it is all the rage in certain secular and progressive circles—and by no means is it limited to the fringes. It has become especially popular among homosexual couples, many of whom pay top dollar for Handmaids who serve a purpose they cannot fulfill themselves.

A cautionary tale

Presidential immunity

Hungry for coverage of last Thursday’s SCOTUS arguments on Presidential criminal immunity, I was nauseous as most of my sources were doing the usual “we know this Court is corrupt; let us now find proof in the hypothetical questions they ask on this case we’re afraid might not go our way.”

Then finally I found sanity:

As several of the justices pointed out, they aren’t making a rule for Donald Trump. They’re making “a rule for the ages,” as Justice Neil Gorsuch put it—one that has to apply to good presidents and bad ones, Republicans and Democrats, high-minded prosecutors and partisan ones. It can be easy to focus on “the needs of the moment,” as Justice Brett Kavanaugh said.

And here’s the fear. If the high court gives presidents too much immunity, the White House could turn into a “crime center,” as Justice Ketanji Brown Jackson said. Too little immunity, and there’s an endless cycle of prosecutions. The ability to find some vague statute will “be used against the current president or the next president,” Kavanaugh said, “and the next president and the next president after that.”

So how will this all shake out? I can’t say for sure, of course. And oral arguments—even a two-hour and 40-minute session—can tell you only so much. But I predict this will be a unanimous ruling instructing the district court to determine which of the charged acts were clearly outside the authority of the president, whether it was an official act or not.

Open Culture Wars

Our Culture War is a Cold War

True revolutionaries do not need to borrow authority from institutions, because they have the power to take what they want from their unconsenting enemy. The woke Left, whether we want to admit it or not, and whether it is itself conscious of it or not, has no such power. It has only consenting victims.

People on the New Right will probably object, claiming that they’re unwilling to listen to and aren’t convinced by the woke Left but are coerced into acquiescing in its beliefs and required conduct thanks to its institutional power—that they are the victims of a form of violence. But the nature of the new Left’s power is not Schmittian. Instead, its power comes from its capacity to influence the state through … “institutional capture” [a/k/a] “cultural hegemony.”

The irritating proximity of different ways of life, which is inevitable in complex modern societies, would not lead their proponents to such extreme expressions of disdain and mutual hatred if those proponents were made to bear the consequences of their discourse. Without such a prospect, each side can all too safely afford to see the other as an absolute enemy and claim to heroically stand for its cause. In the spirit of Schmitt, no situation is as little political as ours.

The woke Left and the New Right are manifestations of a deeper crisis. Both of them find their origin in the neutral state’s aims to liberate people from the responsibility to determine and to pursue a common good, and therefore focus on the administration of things. The state remains neutral out of fear that our disagreements about the common good might lead us to become enemies. But polarization shows clearly enough that peace reduced to mere coexistence, and the virtues attached to it (tolerance and moderation), fall short of what makes human beings want to form a united people, and ready to cultivate the virtues necessary to achieve such a goal.

Freedom, understood as individual autonomy, can never be the sole or even the main question to which a political regime provides the collective answer: How to live together and still be free?

Our problem is not that Left and Right are bringing us to the verge of civil war, but that their political demands have become completely detached from the reality of the human relations that make the satisfaction of such demands possible and just.

Our ideologically incoherent tribes

Today, the Lewises argue, “Left” and “Right” are competing bundles of unconnected and sometimes incompatible issue commitments held together by tribalism. The authors bring to bear a wealth of social science research that shows that people’s issue commitments are more heavily influenced by group loyalties than by philosophical consistency. They also catalogue a history of various political stances that, for example, began as Right, then were considered Left, and sometimes back again, depending on the coalitions’ needs. Trade protectionism, for example, was “Right;” then “Left;” now “Right” again (or maybe “Right” and “Left”). Foreign interventionism took the reverse course. Today what counts as “Right” and “Left” has become conflated with party, and party with the views of individual leaders. All of this, the Lewises contend, cuts strongly against the “essentialist” concept of ideology and in favor of their “social theory.”

Considering what became of the GOP in 2015-16, this “social theory of ideology” has some obvious appeal, as the GOP now holds policies opposite those held ten years ago, and the change was not gradual and evolutionary.

Rather it is to erase an earned ability to know and to use diverse and localized pockets of the world according to different levels of personal investment and responsibility. Playing in her first real WNBA game in 579 days, Brittney Griner did something Friday night in Los Angeles that national television audiences hadn’t seen her do in a long time: The Phoenix Mercury center stood for the national anthem.

She stopped doing so in 2020 but has resumed the practice after returning from 10 months of imprisonment in Russia. “One thing that’s good about this country is our right to protest,” Griner said after the game when I asked her about the issue. “You have a right to be able to speak out, question, to challenge, and do all these things. [After] what I went through, it just means a little bit more to me now. I was literally in a cage and could not stand the way I wanted to … and a lot of other situations. Just being able to hear my national anthem, see my flag, I definitely wanted to stand.”

Telling statistics from Tavistock

The Tavistock Centre, the sole facility in the NHS dedicated to [gender reassignment], kept statistics on the children who came to their doors. Among those referred in 2012, ninety percent of natal girls and 80 percent of natal boys reported being same-sex attracted or bisexual. There is no inherent relationship between trans and gay and bi people. So why this staggering overlap? No answer. If a Christianist hospital was busy changing the sexes of overwhelmingly gay kids, so that they became straight, what do you think the gay rights establishment would say? But when a queer facility does exactly that, all the worriers are bigots.

So many potentially gay children were being sent down the pathway to change gender, two of the clinicians said there was a dark joke among staff that “there would be no gay people left.” “It feels like conversion therapy for gay children,” one male clinician said. “I frequently had cases where people started identifying as trans after months of horrendous bullying for being gay,” he told The Times. “Young lesbians considered at the bottom of the heap suddenly found they were really popular when they said they were trans.”

Another female clinician said: “We heard a lot of homophobia which we felt nobody was challenging. A lot of the girls would come in and say, ‘I’m not a lesbian. I fell in love with my best girl friend but then I went online and realised I’m not a lesbian, I’m a boy. Phew.”

You might imagine that, given this record, the queers would go out of their way to reassure us, to show how tight the safeguarding is, how they screen thoroughly to ensure that gay kids are not swept up in this. But they regard the very question of whether gay kids are at risk as out of bounds.

Andrew Sullivan, Notes on a Medical Scandal. I don’t recall Sullivan ever before penning such a crie de couer, but I’m glad he did. You should read the whole thing if you can, bearing in mind that “queer” isn’t used as an insult but as the self-chosen adjective of the activists he’s opposing.

I had not known the “staggering” extent of the overlap between homosexual attractions and subsequent trans identification, but had been aware that most adolescents who presented with gender dysphoria would, if denied medical transition, eventually settle into conventional gay or lesbian identities. That probably is why the trans ideologues are ruling the very question of whether gay kids are at risk out of bounds, transphobic and evil.

I should also mention (confess?) that I have previously overlooked (not just underestimated the “stick” of anti-gay bullying, underestimated the role of qualms about homosexual attraction, and overestimated the “carrot” of social valorization as motives for kids to declare themselves trans.

Inconvenient parallel

California banned conversion therapy for minors in 2012. That law later withstood two legal challenges. I wonder if the precedents in those cases will affect legal challenges to the Texas and Florida bills [banning gender transitioning procedures for minors] as judges weigh whether legislators overreached in denying treatments many trans kids want.

The ancient philosophers’ primary question was what makes the best regime. Democracy certainly did not qualify. Why not? The answer was simple. They thought democracy was a messy system, systematically undermining the rule of law, profoundly partisan, often hostile to the most prominent leaders and citizens. The famous defense of democratic Athens delivered by Pericles in Thucydides’ The Peloponnesian War is in fact more a defense of Athens and Athenian imperialism than of the democratic political model. When Plato and Aristotle wrote their scathing remarks about the Athenian system, they thought it was already in decline and Athens might soon become a victim of the crisis from which it would not be able to recover. And this is exactly what happened.

  • A student told me there were no objective moral truths.  I mentioned a precept of the Decalogue, and asked “What about that?”  He replied, “That’s not morality, that’s justice.”  But if we take justice in the classical sense – giving to each what is due to him – almost all morality is about justice.  To my wife, I owe fidelity; to my parents, honor; to the child whom I sire, an intact family in which to enjoy the care of me and his mother.
  • A warning to intellectuals such as myself. Supposing the existence of square circles, you can do a lot of things: You can make syllogisms about them, you can develop theories about them, you can even prove theorems about them. But that doesn’t mean that they exist.
  • As a Christian, I believe in the Messiah.  That doesn’t mean I have to like political messianism, which we find both on the right and on the left.  The difference is that left-wing political messianism is usually utopian, trusting the hero to take us to a political promised land — but right-wing political messianism is usually reactive, trusting the hero to save us from the crazies who believe in utopia.  The advantage here lies with the left, because unfortunately, most people are more impressed by lunatic visionaries than by persons with no vision at all.

DeSantis head-scratcher

Some of what Ron DeSantis is doing seems sensible, some dubious, some flat-out weird. What in heaven’s name is the purpose of the “2-minute opening remarks” in the fifth item on this list?

Reparations

A group of prominent Democrats are calling for $14 trillion to be paid as reparations to the descendants of slaves. The bill was introduced by Missouri Rep. Cori Bush, who said: “The United States has a moral and legal obligation to provide reparations for the enslavement of Africans and its lasting harm on the lives of millions of Black people.” I’m on board with reparations. At least, I think it’d be better to do a big reparations shebang—cut checks and call it a day—than the strange sort of slow-drip reparations plans we see in liberal institutions. Like, yes, $14 trillion is a lot of money. But if the alternative is Robin DiAngelo trainings till the end of time and making the MCAT illegal and allowing people to self-ID as doctors because that’s more equitable, then $14 trillion is a bargain. 

But here’s why reparations … will never happen: simply cutting checks to the descendants of slaves means shuttering all the thousands of racial justice nonprofits that serve as an employment program for America’s white grad students ….

Living spaces

Village versus good Urbanism

Modern households with no shared good can end up feeling this way, with each of the members going off to pursue their own aims. Returning, they can only robotically ask, “How was your day?”

This phenomenon is one reason some describe New Urbanist communities as “creepy.” New Urbanist development Seaside, Florida was chosen as the set for “The Truman Show” because it does such a good job at creating the material presentation of a community, while giving some the sense that it is not quite real. Good urbanism, and Seaside is a nearly perfect example, can certainly bring people together, but one must admit that the pattern of causation is a bit backwards.

Phillip Bess, in his important book, Till We Have Built Jerusalem, throws cold water on the aspirations of his fellow urbanists, saying that “something more than urban form is going to be required for a genuine renewal of traditional urbanism. To what extent do the realities of contemporary life even allow for, let alone encourage, a new traditional architecture and urbanism?

We may be able to build Mayberry architecturally, but if it didn’t arise from a real community pursuing a real common good, it would only be a theme park—just a soulless Frankenstein’s monster of urban form. Individualists living in these well-designed neighborhoods may appreciate their beauty, but they will only be lonely individualists mimicking life in a healthy human settlement, like the strangers sharing a home.

Not so simple a story

Fifty years ago, few would have predicted that the American South would emerge as an economic dynamo — and that people would be flocking to places like South Carolina and Tennessee, but it’s happening.

So can we tell a simple story here: Republican policies work, Democratic policies don’t?

Well, not quite. When you look inside the red states at where the growth is occurring, you notice immediately that the dynamism is not mostly in the red parts of the red states. The growth is in the metro areas — which are often blue cities in red states.

If you look at these success stories you see they are actually the product of a red-blue mash-up. Republicans at the state level provide the general business climate, but Democrats at the local level influence the schools, provide many social services and create a civic atmosphere that welcomes diversity and attracts highly educated workers.

We know the policy mix that creates a dynamic society. We just don’t yet have a party that wants to promote it.

As if disinformation wasn’t bad enough already

Don’t ask who’s funding all the disinfo lists: The nonprofits affiliated with the Global Disinformation Index are hiding just about everything they can. Typically, in exchange for the tax benefits of being a nonprofit, these groups are required to disclose information about leadership and funders. Not the ones around the GDI, which has been a central player in the new censorship efforts and now cites “harassment” as the reason they need to stay super private. From a great Washington Examiner investigation:

“I don’t think I’ve ever seen a 990 that excludes the names of officers and directors,” said Alan Dye, a partner at Webster, Chamberlain & Bean who has specialized in nonprofit law since 1975. “And I’ve looked at hundreds.”

Exonerating witches

Some legislatures, apparently having nothing better to do, are playing with Bills to exonerate those convicted of witchcraft in the 17th century. But they’re meeting some resistance in Connecticut:

The fear in Connecticut, as Republican senator John Kissel put it, is that a precedent would be set; that we would “have to go and redress every perceived wrong in our history”. Similar concerns have been expressed elsewhere. A journalist writing in the Scottish newspaper The Herald worried that pardons vilify accusers and that “we should not judge people for living in the past”.

Yet, it remains reasonable to ask: how can we exonerate a crime that modern society no longer believes exists? This is a question not just of history, but of jurisprudential ethics. An empirically supported understanding of “the great witch-craze” should inform questions of whether we need to act, and if so what to do. Are we quashing what now seem like unsafe convictions of witchcraft or offering modern pardons for contemporaneously just ones?

If we are to exonerate convicted witches, we must ensure that the process is historically rigorous. It undermines the enterprise if, say, we set out to pardon five million people tried for witchcraft when, in fact, we have evidence for only around 100,000. We should know that our ancestors were surprisingly sceptical and wary about pointing the finger, and that across continental Europe about half of trials resulted in acquittal. In England and Connecticut, it was more like 75%, owing to the caution of judges and juries about passing guilty verdicts where the proof for this most secretive crime amounted to little more than hearsay.

That’s a bit like the people who can never claim to be tolerant because they say they like (or even love) those they tolerate; you actually need to dislike something in order to tolerate it.

In that vein, I freely admit that I dislike drag, and always have; I nevertheless tolerate it as a lesser evil than suppressing marginal uses of free expression.

The U.S. lecture probably will be about “tolerance” of every flavor of sexual practice, preference, orientation, or line-blurring. By “tolerance” will be meant “enthusiastic approval and suppression of those who dissent.”

I suspect that a major motivator for America’s tolerance toward sexual deviance from norm is that it allows for a Pharisaical attitude in attention-misdirecting from our own sexual transgressions:

I’ve written in this blog numerous times about the “revenge of conscience. Conscience wreaks this revenge in a particularly spectacular way in the domain of sex. We aren’t really shameless; rather, because of our shame, we make excuses.  People on the left make excuses for their shameful practices by saying that now all perversions are okay (in fact, they aren’t perversions). People on the right implausibly say “No, only my shameful practice is okay. Yours isn’t.”  Is it any wonder that the liberal dog is winning this fight?

Ineffective altruism

[Ken Griffiths’ $300 million dollar] gift basically funds Harvard qua Harvard, carrying coals to the Newcastle that is the school’s almost bottomless endowment, which even by ineffective-altruist standards seems indefensibly useless and pathetic. Even if Griffin’s interests were ruthlessly amoral and familial — all-but-guaranteed admission for all his descendants, say — the price was ridiculously inflated: The Harvard brand and network might be worth something to younger Griffins and Griffins yet unborn, but not at that absurd price. And if he’s seeking simple self-aggrandizement, he won’t gain it, since nobody except the chatbot in charge of generating official Harvard emails will ever refer to the “Kenneth C. Griffin Graduate School of Arts and Sciences.” (At least make them build you some weird pharaonic monument along the Charles, Ken!)

The sheer unimaginativeness makes Griffin’s gift a useful case study in one important ingredient in our society’s decadence: the absence of ambition or inventiveness among of our insanely wealthy overclass when it comes to institution building. There was a time when American plutocrats actually founded new institutions instead of just pouring money into old ones that don’t need the cash. Projecting the AI future

Today, the World Economic Forum imagines that AI will lead us to a less primitive “utopia”, a 21st-century Promised Land in which people will “spend their time on leisure, creative, and spiritual pursuits”. A safer bet would be drugs and sex robots. Ninety years ago, John Maynard Keynes prophesied, with what looks like eerie accuracy, that machines would make labour obsolete within a century. The prospect filled him with “dread”, because very few people have been educated for leisure.

In 2018, an article in Scientific American predicted that advanced AI will “augment our abilities, enhancing our humanness in unprecedented ways”. This Pollyannaish prognosis ignores the fact that all human capacities tend to atrophy in disuse. In particular, AI is inexorably changing the way we think (or don’t). Students now use ChatGPT to do their homework for professors who perhaps rely on it to write their lectures. What makes this absurd scenario amusing is not just the thought of machines talking to machines, but that intellectually lazy people would employ a simulacrum of human intelligence for the sake of mutual deception.

Compared with the natural endowment of human intelligence, the artificial kind is an oxymoron, like “genuine imitation leather”. AI is a mechanical simulation of only one part of intelligence: the capacity of discursive thinking, or the analysis and synthesis of information. Discursive thinking deals with humanly constructed tokens, including numerical and linguistic symbols (or, in the case of AI, digitally encoded data). While human intelligence can compare these tokens with the things they represent, AI cannot because it lacks intuition: the immediate cognition of reality that roots us in the world and directs our energies beyond ourselves and the operations of our own minds. It is intuition, for example, that tells us whether our nearest and dearest are fundamentally worthy of trust.

  • It’s curious that both left and right seem to think that things are falling apart — but what each side views as remedy, the other views as decline. People often say they wish left and right would “come together to solve the country’s problems," but they define the problems in opposite ways. For example, one side thinks that racism is on the increase and reverse racism is necessary to fight it; the other side thinks that racism was on the decline but that reverse racism is bringing it back in force. Again, one side thinks that crime is an innocent response to deprivation, and that the problem lies in the police; the other side thinks crime is wrong and dangerous, and that although we should help disturbed people, the problem lies in punishing the police and encouraging the criminals.
  • The proponents of the so called “new natural law theory,” or “basic goods theory,” say that we shouldn’t speak of the natural purposes of things.  For example, we shouldn’t say that the natural purpose that anchors the sexual powers is procreation, because this “instrumentalizes” and “depersonalizes” us – it makes us tools for making babies.  This is absurd.  One might as well say that it depersonalizes us to say that the natural purpose of the intellectual powers is deliberating and knowing the truth.

I vote Democrat but/and call myself a socialist because that is the safest place for me to hide. I’m not a bad person; I want freedom and equality. I want good things for everyone. But politics scare and confuse me. I just can’t stand to lose face, so I have to present all of my terribly confused ideals with maximum superficial confidence. If you probe any of my specific beliefs with minimal force, they will collapse, as those “beliefs” are simply instruments of social manipulation. I can’t take my kid to the Prospect Park carousel and tell the other parents that I don’t support police abolition. It would damage my brand and I can’t have that. And that contradiction you detected, where I support maximum forgiveness for crime but no forgiveness at all for being offensive? For me, that’s no contradiction at all. Those beliefs are not part of a functioning and internally-consistent political system but a potpourri of deracinated slogans that protect me from headaches I don’t need. I never wanted to be a leftist. I just wanted to take my justifiable but inchoate feelings of dissatisfaction with the way things are and wrap them up into part of the narrative that I tell other people about myself, the narrative that I’m a kind good worthwhile enlightened person. And hey, in college that even got me popularity/a scholarship/pussy! Now I’m an adult and I have things to protect, and well-meaning but fundamentally unserious activists have created an incentive structure that mandates that I pretend to a) understand what “social justice” means and b) have the slightest interest in working to get it. I just want to chip away at my student loan debt and not get my company’s Slack turned against me. I need my job/I need my reputation/I need to not have potential Bumble dates see anything controversial when they Google me. Can you throw me a bone? Neither I nor 99% of the self-identified socialists in this country believe that there is any chance whatsoever that we’ll ever take power, and honestly, you’re harshing our vibe. So can you please fuck off and let us hide behind the BLM signs that have been yellowing in our windows for three years?

It would be interesting to see a similar parody featuring a standard-issue Right figure.

Three foundational myths of MAGA

While Trumpism is a complex phenomenon, there are three ideas or principles that are consistently present: First, that before Trump the G.O.P. was a political doormat, helplessly walked over by Democrats time and again. Second, that we live in a state of cultural emergency where the right has lost everywhere and must turn to politics to reverse this cultural momentum. And third, that in this state of emergency, all conservatives must rally together. There can be no enemies to the right.

Add these three ideas together, and you have a near-perfect formula for extremism and authoritarianism.

Having a bit of blood in the water, the media (Jamelle Bouie at the New York Times in particular) will be trying to devour Justice Clarence Thomas until they drive him from office (unlikely since Anita Hill could deny him the office), lose interest, or motivate Congress to enact a binding judicial code of conduct (which Chief Justice Roberts has cautioned might violate separation of powers). Stay tuned.


For all its piety and fervor, today’s United States needs to be recognized for what it really is: not a Christian country, but a nation of heretics.

Blogging the ineffable

It occurred to me recently that my blog is an odd project because, increasingly, the things that matter most to me are ineffable.

I’ve read at least one book that “effed the ineffable” by going on and on, shifting to reflect from varying angles. I actually thought it was pretty effective, but you had to be keenly interested in the topic to wade through so much overlapping, kaleidescopic quasi-repetition. (I did find that 24 years of immersing myself in Orthodox Christian worship, as my Parish’s cantor — and not just the Sunday Liturgy — had “communicated” the same things.)

I’ve taken a stab at poetry occasionally, but rarely have thought it remotely successful. Anyway, I once heard it said that the person who becomes a poet to say something is less poetic than someone who becomes a poet because he/she likes messing around with words.

I guess the reason I keep blogging may be that I, too, am going on and on, in prose, shifting to reflect from varying angles — just not between the covers of a single book and without an explicit Master Goal. But in a lot of ways, my blog is a very large commonplace book, but an online friend (we’ve narrowly missed meeting IRL) already took that in his blog (now Substack) title.

Anyway, I actually looked briefly at what WordPress says about my blog (something I rarely do since I’m not writing to be popular), and apparently it’s emailed to 350 addresses, and I assume that some others get the RSS feed. I’m pretty sure that some of the emails are bogus, created for god-knows-what purpose. But a heartening number probably are real people, and to them I say thank you for your indulgence.

A partisan scold as arbiter of “Disinformation”

The preoccupation with “misinformation” and “disinformation” on the part of America’s enlightened influencers last month reached the level of comedy. The Department of Homeland Security chose a partisan scold, Nina Jankowicz, to head its new Disinformation Governance Board despite her history of promoting false stories and repudiating valid ones—the sort of scenario only a team of bumblers or a gifted satirist could produce.

There is something so disingenuous about critical theorists both arguing that they are revealing the real truth about the world in order to change it, and then claiming that they’re just offering an alternative take of history within a liberal context. You can see this intellectually dishonest bait-and-switch in the 1619 Project. It claims something truly radical — that the real founding of America was in 1619 because the core meaning of America is white supremacy, not liberal democracy — and then, when called on it, turns around and says no, silly, we’re just engaging in a thought-experiment to explain how racism has affected all of us, and to provoke debate. Well: which is it? In theory, they tell you it is all compatible with liberalism; in practice, they prove and believe the opposite.

From an official Planned Parenthood website, an about-face that reveals a lot:

Well-meaning folks often contrast “pro-choice” with “pro-abortion,” as in, I’m pro-choice, not pro-abortion. But that’s hurtful to people who’ve had abortions. It implies that abortion isn’t a good thing, that legal abortion is important but somehow bad, undesirable. That’s deeply stigmatizing, and contributes to the shame and silence around abortion, making people who’ve had abortions feel isolated and ashamed. At least one in four people who can get pregnant will have an abortion during their lives, and they should be supported and celebrated. It’s time to retire the phrase “pro-choice, not pro-abortion” for good.

[Sullivan’s critic1]: You’re conveniently forgetting that five of the nine justices (Roberts, Alito, Gorsuch, Kavanaugh, Barrett) were nominated by presidents who lost the popular vote.
[Sullivan’s rejoinder]: That is completely irrelevant. But even it it weren’t, both of Bush’s appointees were picked during his second term, after he won the popular vote against Kerry.

[Sullivan’s critic2]: Currently, several state legislatures have big GOP majorities that in no way reflect the number of votes each party received in the preceding election. My guess is that one or more of these legislatures will act quickly this summer, after Roe is overturned, to outlaw abortion. Will that be an instance of democracy working well?
[Sullivan’s rejoinder]: Yes, it absolutely will. And voters can vote again in November. Again: is it the pro-choice position that no states be allowed to legislate on abortion because gerrymandering exists? What else are they barred from voting on?

[Sullivan’s critic3]: While I am certain there are women who would never have an abortion — and they cannot imagine allowing any other woman to have an abortion — the majority you refer to as “pro-life” is deeply affected by another condition: religion. The majority of the pro-life women you speak of, through their faith, surrendered any sense of having power that isn’t subjected to the approval of the church or their husbands! They have no distinct awareness or appreciation of the fullness of their own free will — their liberty — or their innate freedom to make decisions on their own, entirely independent of their faith. 
[Sullivan’s rejoinder]: I’m afraid this completely misunderstands Catholic teaching on this. Women are not supposed to submit their moral views to their husbands’ approval. And the thinly veiled contempt for religious people — they don’t have any autonomy or agency — is a form of bigotry, in my view.

On that last point, see Eugene Volokh’s contemptuous response to that kind of motivated reasoning, which he no doubt hears a couple of times each week if not each day.

Now when Chief Justice Roberts speaks of the Court as an “institution,” he approaches that concept from a PR perspective–5-4 decisions are bad, incoherent 9-0 decisions are good. Thomas could not care what final votes are. Rather, he worries about attacks on the Court by the political branches, and more recently, from within.

Unlike Justice Ginsburg, no one knows where Chief Justice Roberts is. To quote Aaron Burr, “Talk less, Smile more, Don’t let them know what you’re against or what you’re for.” NFIB v. Sebelius may have saved the ACA, but the controlling opinion destroyed the Supreme Court as we know it. The anonymous conservative told Politico:

“There is a price to be paid for what he did. Everybody remembers it,”

Roberts won the battle, but lost the war. Now Thomas is making this point explicitly.

Selective non-enforcement

Of the laxity of law enforcement in protests at Justices’ homes:

When it comes to the contrast to Jan. 6, what stands out to me is actually a similarity: a large protest gathered on Capitol Hill and authorities responded with much too little force to disperse it — including after it got way out of hand. Where things differ has been the aftermath, with federal prosecutors now aggressively prosecuting people who merely wandered into the building after the most violent and aggressive perpetrators had pushed their way inside. That seems like overreach in the opposite direction — discretion erring on the side of undue harshness. We should absolutely be throwing the book at everyone who ransacked the building and sought to commit acts of violence against members of Congress or the vice president in order to overturn the election. But that likely doesn’t describe everyone, or even most of the people, present at the protests that day.

Damon Linker (who, should it not be clear, favors discretionary non-prosecution of smallish, non-menacing demonstrations at the Justices’ homes).

I’m acquainted with someone who “merely wandered into the building after the most violent and aggressive perpetrators had pushed their way inside” the capitol on 1/6/21, but is being prosecuted nonetheless. The Feds have lost at least one such case at trial, and I’m hoping they’ll now relent on the others.

Point is: I’m willing to extend the same grace I want for him to wrong-headed people who peacefully protest at justices’ homes – even if there’s a federal law that facially makes that illegal.

Overturning nature

It’s really very strange. One hundred thousand people die of opioid overdoses in a single year, and elites throw up their hands and do nothing. Meanwhile, they put untold millions into transgender activism and insist that the fullest resources of the medical-industrial complex must be employed to attain its goals.
