Comparative Free Speech Law

While every liberal democracy in the world claims to guarantee free expression in some form, the United States is essentially the only country where the government may not “take sides” on contentious issues by censoring expression based on the speaker’s viewpoint. As the post-October 7 examples show, many European countries have indeed taken a side in the public discourse over the Israeli-Palestinian conflict—in a way that might surprise many American observers: calls for a ceasefire and an end to what they see as an Israel-perpetrated genocide are criminally prohibited hate speech, while support for continued attacks is constitutionally protected. This strange result illustrates the unintended consequences of allowing governments to pick and choose which beliefs are unlawful “hate speech” and which are fair criticism.

The notion—dominant the in most of the world—that hateful speech is not “free speech” dates at least to the global post-World War II reckoning with Nazism …

[H]ate speech is notoriously hard to define, and these systems often give wide latitude to officials to decide what these terms even mean and who should be prosecuted, discretion which officials often use in inconsistent and unpredictable ways.

How governments are responding to Israel-Gaza protests illustrates these radically diverging constitutional commitments to viewpoint neutrality. European national officials defended some of these pro-Palestinian restrictions primarily on public-order grounds more than stifling hate. But even so, the double standard implies that they view much of anti-Israeli speech as inherently anti-Semitic, and therefore, beyond the pale. This leads to a paradox, in which criticizing Muslims or Arabs as a group can constitute unlawful hate speech, but many expressions of support for Islamic-Arab groups are also prohibited, because of the threat that the government thinks those groups pose.

These examples offer a cautionary tale: When empowering the government to decide which beliefs are illegitimate, future policymakers may not use that power in ways you like or anticipate. They may even decide that your own viewpoints are the illegitimate ones—as with the song of South African anti-apartheid activists, “Shoot the Boer (i.e., white farmer)”; gender-critical feminists’ insistence that natal sex is critical to sexual orientation; and more recently, Palestinian advocates’ calls for a ceasefire and a “free Palestine.”

Scholars and activists celebrating new and stronger hate-speech laws might therefore consider Justice Hugo Black’s 1952 reaction to a (now largely discredited) decision upholding a conviction for disparaging Black Americans: “If there be minority groups who hail this [development] as their victory,” he wrote, they should contemplate Pyrrhus of Epirus’s observation: “Another such victory and I am undone.”

In 1975, the Supreme Court’s O’Connor v. Donaldson decision established a national standard that the mentally ill could only be involuntarily treated if they represented an immediate threat to themselves or others. This completely removed actual medical necessity from the equation, and the standard directly incentivized hospitals to discharge very ill patients, many of whom leave these useless emergency room visits and immediately abuse drugs, self-harm, commit crimes, attack others, or commit suicide …

There are desperately ill, utterly impoverished, terribly vulnerable people living on the street right now. They are exactly the kind of people the left should fight for. But because we have become such a caricature of ourselves, we are incapable of acknowledging that some people really are fucked up, that some people really are dangerous, that some people really aren’t just different but are sick, ugly sick, violent sick, no-silver-lining sick. Not beautiful and poetic madness but drug addicted, horrifically paranoid, caked-in-shit sick. And what people like that need is to be forced into treatment to save their lives. But sunny, false notions that everyone muttering to themselves on the subway hides a sweet little self-actualized busy bee inside of them, and an impossibly myopic fixation on the abstract rights of people whose brains have hijacked their minds, has left us unable to provide the actual help the severely mentally ill need. I have found no way to penetrate the liberal consciousness on this issue. Because it’s conservatives, I guess, who complain about violence and disorder on the streets.

Abortion politics

Even if I were still a single-issue (abortion) voter (I’m not; I’ve seen too many insane and/or phoney “pro-life” candidates), the GOP no longer make a compelling case on that issue.

Hamas Hyperbole, Media Credulity

In a May 6 report, the UN stated the death toll was 34,735, including 9,500 women and 14,500 children, or at least 24,000 civilians. 

But two days later, the UN quietly revised its figures, stating that 50 percent fewer civilians had died. The total number of deaths is about the same at 34,844, but that number includes 4,959 women and 7,797 children—a total of 12,756 civilians. (And this from the United Nations, whose General Assembly adopted 15 resolutions on Israel in 2023, compared to seven for the rest of the world combined.) 

This revision is the clearest sign yet that Hamas’s statistics cannot be trusted. As David Adesnik, senior fellow at the Foundation for the Defense of Democracies, says: “The UN should state clearly that it has lost confidence in sources whose credibility it has affirmed for months.”

Spencer says that even the revised UN figures probably overstate the death toll, because the numbers aren’t limited to people who were killed in the war. “The UN numbers include every death in Palestine no matter what the cause was,” Spencer told The Free Press. “Every natural death, missing person, anyone killed by Hamas.”

And yet, so far not a single major media platform, save Fox News, has reported on the new UN numbers.

On a Newsweek article skewering Viktor Orbán for his friendliness toward China:

China doesn’t give a damn what Hungary does with its borders, or with LGBT policy. That’s not to say that China doesn’t have and pursue its own interests. The Chinese are not altruists. It’s just that dealing with them, countries can preserve sovereignty in ways the West makes harder and harder to do.

Talk to African diplomats and lawmakers, and you’ll hear from them deep exasperation with the way Western countries constantly push feminist and LGBT ideology on them, as a condition of foreign aid. I invite you to spend just a little bit of time googling “LGBT”, “feminist” and “foreign policy”. Western institutions are as militantly evangelical about these ideologies as the Church was about religion in the Age of Discovery.

If your country wants and needs development aid, but wants to maintain cultural sovereignty, you’re going to look to China. To be very clear, Chinese support also has strings attached! But they are different strings. My point is simply that mindless cheerleaders for the Western establishment, like the Newsweek essayist, should make the effort to see what things look like to people outside the Greater American Empire.

Strong People

Whenever I watch a Netflix show these days, it seems as if there are several themes that are yawningly predictable. One of them is the motif of the “strong woman.” (I’m not referring to the South Parkstrong woman.” That is a subject for another day.) 

I mean the way in which female characters must now almost always be shown to be people of unbelievable strength—including rather unbelievable physical strength. One reason the recent Amazon adaptation of J.R.R. Tolkien’s Lord of the Rings (called The Rings of Power) flopped is that it tried to push this motif at every turn. In one especially implausible scene, a “strong woman” fights off a whole horde of armor-clad men with her bare fists. We were meant to marvel at her strength. Most people reached for the off switch.

I didn’t make it past the first 15 minutes or so of The Rings of Power, but it took me 6 episodes to reach my limit on Apple TV’s Sugar, which ended with a similarly absurd show of superhuman strength.

Zero-sum

Maybe the prospective [wedding service] customers, like many Americans, do not see transcendent meaning in the ceremonial commencement of matrimony, because they associate a wedding as admittance to an institutional legal fiction that allows one access to nothing more than a cluster of political and social privileges not available to other friendships. So, given this understanding, it is not surprising that the customers see the provider’s refusal as a negative judgment on the public legitimacy of their union. Thus, it’s easy to see why the customers would be offended by the provider’s refusal and subsequently seek legal redress. But what the customers fail to see is that their demand that the courts force the providers to rescind their denial and be punished for it is really a demand that the state force the providers not to exercise their freedom of worship, the liberty not to participate in, or not provide assistance to, ceremonies that one believes have sacramental significance.

Between two worlds

The people here were heart-broken over the shelling going on in the Donbass. I saw a video posted by an American in Ukraine showing a march of parents in Donetsk carrying photos of their children who had been killed as a result of the shelling. I had tears in my eyes watching. We all knew it was the U.S. that blocked efforts to implement the Minsk Accords set forth by France and Germany which called for the cessation of the shelling. The people in the Donbass are essentially Russians living in Ukraine. I’ve stated several times that Ukraine refused them independence after the coup removing the democratically elected president of Ukraine. The residents were not allowed to speak Russian, their native language, or, in some cases, even to worship in the Russian Orthodox church. Yet it is still a practical requirement that journalists refer to Russian troops going into Ukraine as an “unprovoked invasion.”

Hal Freeman, an Orthodox American expatriate living in Russia. He is probably too credulous about Russian news of the war, as are most Americans about the American-flavored version, but I consider his blog that of an honest Christian living between two worlds. He’s especially valuable for things like reminding Americans that the U.S., through proxies, subverted and overthrew a democratically-elected Ukrainian government we considered too pro-Russia — things our press will rarely remember.

His final paragraph, as he updates his personal status (his younger Russian wife died leaving him an aging widower with young children) is worth chewing on:

I have had some family members in America encourage me to come back there. But I still think it would be too disruptive to the children. And, furthermore, the U.S. does not look like an attractive place to live anymore. It continues on a trajectory that I do not want to move my children back to. I wish it were not so. I would love to see my family there and have not given up the dream that my toes will be in the South Carolina sand when we hopefully can visit next summer.

Why Conservatism failed

The modern conservative project failed because it didn’t take into account the revolutionary principle of technology, and its intrinsic connection to the telos of sheer profit. Decrying left-wing revolutionary politics and postmodern anarchy, conservatives missed that the real moral relativism was to believe that one could change the material form of society without directly affecting its substance or its ends.

In between great-books seminars, conservatives have decried any interference in what technologies the all-knowing market chooses to build, while taking no stance on what technologies we ought to build and accepting with equanimity massive research investment from the private economy and military-industrial complex, at most wringing their hands about the speed and direction of social change (while accepting its inevitability). Not for nothing did the Canadian philosopher George Grant, in an essay on “the impossibility of conservatism as a theoretical stance in the technological society,” describe them as “those who accept the orientation to the future in the modern but who want to stop the movement of modernity at points which touch their special interests.”

Shullenberger adds more weight to the argument that to live conservatively is deeply counter-cultural and might even require substantial withdrawal from society — maybe as Hal Freeman has. But even Hal has American Social Security.

We don’t know if Reverend Warnock himself has ever personally facilitated an abortion, but we do know he will do everything in his power to keep facilitating them for countless women he will never know. And this is supposed to give him the moral high ground? An old Norm Macdonald line comes to mind, from the scene in Comedians With Cars Getting Coffee where he’s discussing Bill Cosby with Jerry Seinfeld. “The worst part is the hypocrisy,” Seinfeld says earnestly. “Huh,” Norm goes, poker-faced. “I kinda thought it was the rape.”

So, in the end, neither candidate can hide behind a veneer of moral respectability here. This is a choice between two evils. And yet, many voters who share my convictions remain convinced that they must choose …

… My concern is those earnest voters who have still constructed such a consequentialist frame around their vote that there truly seems to be nothing that would cause them to withhold it from a Republican, provided the Democrat was always worse.

I hate to bring him up, but Trump obviously hovers behind all this. Cards on the table, I didn’t vote for him in 2016 or 2020. Many people didn’t vote for him in 2016 but decided to do so in 2020. Now, in the wake of Dobbs, they feel vindicated …

I have seen this presented as a “conundrum” for the conservative voter, something that has to be reckoned and wrestled with. This might have an effect on some people, but I’ve always been singularly immune to this sort of challenge once my mind is firmly made up. I cheered the fall of Roe as loudly as any Trump voter. Yet, in my own mind, I remain quite happy not to have cast a vote for Trump in either year. Because a vote, to me, is more than a utilitarian ticking of a box. It’s more than getting the right warm body in the right seat so that he can vote the right way. To me, a vote is a statement: This candidate is worthy.

When the game is this cynical, we are under no obligation to keep playing. What happens next, whatever happens, is not on us. It is on the people who forgot what it means to be worthy.

The way we do education in America results in the “overproduction of elites,” [Patrick] Deneen declared. “There need to be fewer people like me, with jobs like mine.” When I laughed at this, he smiled and said: “I mean, gosh! Just try getting someone to do brick work on your house.”

“So instead of stripping society down to atomized individuals in a ‘state of nature’ and then building up Lockean rights,” I asked Deneen clumsily, “you’re starting with the family, and then society grows out of that?”

If you begin by building from that point and you think about the ways that those institutions are under threat from a variety of sources in modern society… to the extent that you can strengthen those institutions, you do the things that someone like David French wants, which is to track a lot of the attention away from the role of central government. One of the reasons liberalism has failed in the thing it claims to do—which is limiting central government—is precisely because it is so fundamentally individualistic that radically individuated selves end up needing and turning to central governments for support and assistance.”

J Budziszewski replies to an anguished postliberal, who’s ready to take some real action against the perceived existential threat of secularism and bad religion. This strikes me, with my long interest in religious freedom law, as a key part of the reply:

It is one thing to say that moralistic monotheism should enjoy some special recognition or privilege over and above the protections that all systems of belief receive through the Free Speech and Assembly Clauses.  It is quite another to say that systems of belief outside of it should be denied freedom of speech and assembly, or that we should round up their adherents and put them in jail.

I would add that I always thought “we must pass a law!” was an anti-conservative impulse.

It isn’t only Hart’s view of the world that has been consistent. It’s also his style. Clause follows clause like the folds in a voluminous garment, every noun set off by beguiling and unusual modifiers (plus some of his old favorites, like “beguiling”). In one way, at least, he is the least American of writers, in that adjectives and adverbs do not give him that twinge of guilt that so many of us have picked up from Hemingway and Twain, the suspicion that we are using them to distract the reader from our failure to describe some particular action or detail—some verb or noun—precisely enough.

For several hours on December 18, 2020, some of the greatest legal minds of a generation gathered at the White House for a meeting that would change the course of history. Sidney Powell was there, as were onetime national security adviser Michael Flynn and former Overstock CEO Patrick Byrne. Rudy Giuliani showed up, as did Mark Meadows. Shortly after it concluded, then-President Donald Trump sent a tweet.

“Statistically impossible to have lost the 2020 Election,” he wrote. “Big protest in D.C. on January 6th. Be there, will be wild!”

It’s a bit of a false note for the Dispatch to lead with such snark, but I like that false note this time.

Colorado Republican Rep. Lauren Boebert caused a stir in late June when she denounced the separation of church and state as “junk” and proclaimed that “the church is supposed to direct the government, the government is not supposed to direct the church.” Bettering her usual performance, she was half-right.

As I watched Ms. Barrett fielding questions from senators [at confirmation hearings], I realized two things.

Regardless of whether the committee proves Trump legally culpable for January 6, at least one top Trump adviser held him morally responsible for that day. After police shot and killed Trump supporter Ashli Babbitt as she attempted to breach the Capitol, Trump’s former campaign manager Brad Parscale texted Trump operative Katrina Pierson. “This is about Trump pushing for uncertainty in our country,” Parscale—who worked on both the 2016 and 2020 campaigns—wrote, in messages provided by the Committee. “A sitting president asking for civil war. This week I felt guilty for helping him win [in 2016].”

“You did what you felt right at the time and therefore it was right,” Pierson replied.

“Yeah,” Parscale wrote. “But a woman is dead.”

“You do realize this was going to happen,” Pierson said.

“Yeah,” Parscale said. “If I was Trump and knew my rhetoric killed someone.”

“It wasn’t the rhetoric.”

“Katrina. Yes it was.”

One month later, Parscale tweeted: “Statement to Trump: ‘If they only impeached you twice, you need to run again… I’m in, are you?’”

Normal bad, not existential threat

Since it’s clear (at least for now) that Ron DeSantis is the Republican most likely to unseat Donald Trump, we’re starting to see a predictable line of pieces online. Trump is bad, but DeSantis might be worse. Trump was incompetent authoritarian. DeSantis is ruthlessly efficient. You can read versions of that argument in MSNBC, the Washington Post, MSNBC, New York Magazine, and MSNBC.

I started reading many of these pieces earlier this morning, and I finished just as today’s January 6 Committee hearing got underway. The contrast, quite frankly, was jarring. One the one hand, DeSantis’s critics were describing a politician who played by the rules to enact policies they didn’t like. On the other hand, I watched yet another account of a politician who came within one Mike Pence “yes” (to his harebrained electors scheme) to plunging America into the worst constitutional crisis since 1861.

Let me make this analysis as simple as possible. Donald Trump presents an existential threat to the continued existence of the United States as an intact republic. Our nation may not survive a second Trump term. Ron DeSantis has his flaws, but he’s absolutely within the bounds of a mainstream American politician.

I was tempted to stop there, but I read on. French is not happy with DeSantis and spells out clearly why he’s not. Progressive Democrats won’t like his analysis, though.

Introduction to the analysis:

My critique of DeSantis has less to do with Donald Trump and more to do with Kamala Harris or Gavin Newsom. By that I mean that DeSantis is more like a California Democrat than he is like Donald Trump. Specifically, both DeSantis and Harris are culture warriors who are prone to fight the culture the wrong way—by deploying state power at the expense of civil liberties.

Portraits in Credulity

Can you believe that 38 percent of Democrats are LGBT? And that a whopping 44 percent of Republicans earn over $250,000 per year? Those stats are from a 2018 study published by the University of Chicago based on 2015 data, but I may have messed up the delivery a little. Actually, it’s that Republicans in the study reported that 38 percent of Democrats are LGBT and Democrats believe that nearly half of Republicans make a quarter-million dollars a year. In truth, 6 percent of Democrats identify as LGBT and 2 percent of Republicans earn that high a salary. Democrats, themselves, also overestimated the number of LGBT members in their own party. But out-group members were far more likely to misperceive the opposing party’s makeup.

And aside from partisanship, interest in politics was also a great predictor of who was more likely to be wrong, i.e., consuming more political news and social media made a respondent more likely to misjudge the makeup of either party. “Interest in political news will be positively correlated with beliefs about the share of partisans belonging to party-stereotypical groups,” the authors reported.

I’d suspect these biases have gotten worse since 2015. But as I keep seeing surveys about young people refusing to be friends with someone who doesn’t share their political beliefs or people who don’t understand that social media curates their feed to show them political content that is most likely to agree with and shield them from alternative viewpoints, it’s worth a reminder that there’s no substitute—not even this newsletter—for striking up a conversation in the grocery store line, calling up a potential new friend for a beer, or asking someone a question about how he views the world and actually listening to the answer. Turning the tables

New York Governor Kathy Hochul recently allocated $35 million to provide special assistance to abortion providers, and there is a proposal to subsidize women’s travel to New York to procure abortions. In New York City, homeless men urinate in doorways and drug addicts shoot up in public at midday. In the face of these realities, Hochul’s commitment of resources to ensure the wide availability of abortion services seems more than a little perverse. The contrasts are even starker in Illinois. As the death toll of gun violence increases on Chicago’s South Side, Governor J. B. Pritzker has called for a special legislative session to address, not the murder rate, but “reproductive rights.”

If you can’t measure it, it’s not "God’s Blessing"

I have been listening to Christianity Today’s podcast series The Rise and Fall of Mars Hill, which of necessity focuses on the doings of pastor Mark Driscoll. Episode 11, a really long one, is playing as I type.

I can’t decide if this is a complicated story or a really simple one:

  1. Much of Evangelicalism is congenitally more interested in numerical growth than in discipleship and true Christian growth.
  2. That propensity, combined with a narcissistic pastor who produced numerical growth for a number of years, completely broke down any pastoral accountability or Christlikeness.

Late in Episode 11, there was this quote:

If the goal is Church growth and not Church health, one way to do it is get a really charismatic, dynamic personality that attracts a large number of people and let him do whatever he wants. And then he’ll never leave. And the people will say "I go to so-and-so’s church. So-and-so is my pastor."
"Have you ever met him?"
"No, I never met him. He’s my pastor."

The speaker was Mark Driscoll, the disgraced Mars Hill pastor, himself.

A simple story, I think. And it’s being replayed, a bit more softly and in a lower register, throughout Evangelicalism today.

Because in much (most?) of Evangelicalism, numerical growth is per se "God’s blessing on pastor so-and-so’s ministry."

Just sayin’.

Thinking Locally

  • II. … Unless one is willing to be destructive on a very large scale, one cannot do something except locally, in a small place. Global thinking can only do to the globe what a space satellite does to it: reduce it, make a bauble of it. Look at one of those photographs of half the earth taken from outer space, and see if you recognize your neighborhood. …

Guilt by free association

The only motivation for the invocation of Schlafly seems to be that, as [Linda] Greenhouse notes, she was the subject of a television mini-series in 2020, and that both were lawyers with large families. "Forty years later, more than a few people looked at Amy Coney Barrett and saw Phyllis Schlafly," Greenhouse writes, with no indication of who those people were. "And how could they not, given the similarity in the two women’s biographies?" This isn’t even guilt by association. It’s guilt by free association.

Things one couldn’t say 30 years ago

Caveat on the headline: the first edition of After Virtue was published in 1981. I don’t know if it included this acknowledgement. In my neck of the woods, acknowledging learning from Marx in 1981 would at least get you the side-eye. I personally didn’t learn from him until later, after Communism fell, and sensible people stopped obsessing about it.

It’s the algorithms, stupid!

I think it would be preposterous to deny that there are good things [about social media]. My favorite thing is people with rare diseases finding each other and being able to compare notes. That wasn’t possible before. But it has to be said that all of those good things could happen without this algorithmic overlord. You could have all of the good of the internet and all of the good we associate with social media, which is real, without this crazy-making business model. And that’s why I find a fallacy in a lot of thinking that’s like, well, we just have to deal with Facebook making the world darker and crazier because we need this or that. That’s not true at all.

It’s still the algorithm, stupid!

Readwise suggests something it thinks I might like to read at the end of each day’s review of things I have read. Friday’s suggestion was this:

Goddess worship, feminine values, and women’s power depend on the ubiquity of the image. God worship, masculine values, and men’s domination of women are bound to the written word. Word and image, like masculine and feminine, are complementary opposites. Whenever a culture elevates the written word at the expense of the image, patriarchy dominates. Ummm, I don’t think so.

It probably is selling briskly in a niche market of which I’m not a part. But it reminds me of some crazy PhD. thesis in a world where a high proportion of sane ideas have been explored by prior doctoral candidates. After defense of the thesis, the newly-minted PhD will have become heavily, heavily invested in the thesis, howsoever absurd, and will carry it into the academy with him/her.

The most baneful effects of this pattern are in theology, where an original contribution to the literature will be very likely heretical.

Anything that fits the narrative will be accepted tout suite

The MSM took the ludicrous story of Jussie Smollett seriously because it fit their nutty “white supremacy” narrative. They told us that a woman was brutally gang-raped at UVA (invented), that the Pulse mass shooting was driven by homophobia (untrue) and that the Atlanta spa shooter was motivated by anti-Asian bias (no known evidence for that at all). For good measure, they followed up with story after story about white supremacists targeting Asian-Americans, in a new wave of “hate,” even as the assaults were disproportionately by African Americans and the mentally ill.

We all get things wrong. What makes this more worrying is simply that all these false narratives just happen to favor the interests of the left and the Democratic party. And corrections, when they occur, take up a fraction of the space of the original falsehoods. These are not randos tweeting false rumors. They are the established press.

Andrew Sullivan, decrying the deceitfulness of mainstream media — to which media, nevertheless, sensible people have no good alternative.

(I increasingly think we do have a good alternative: tune out the news almost entirely. What good does it do me in Indiana, for instance, to have any opinion whatever about the interaction of Kentucky Catholic School boys and an older native American in DC?)

Summit for Democracy

Tensions are indeed rising between the U.S. and China, but that’s not primarily because the former is a democracy and the latter is authoritarian. It’s because America is a global hegemon that projects power into China’s near abroad, and China is a rapidly rising power seeking to expand its influence across East Asia. That places the two countries on a collision course, and whether they’ll prove able to avoid armed conflict will have very little to do either country’s form of government.

"Polite" has never been so flexible a term

Rep. Marjorie Taylor Greene tweeted out the 13 representatives’ office phone numbers and urged Americans to “politely say how they feel about these traitor Republicans voting to pass Joe Biden’s Communist agenda.”

MTG’s "Politely address traitors who voted for Communism" does not pass the plausible deniability test when things like this were the response:

They did. “You’re a f—ing piece of s— traitor,” one voter said in a voicemail left for GOP Rep. Fred Upton, vice chair of the Problem Solvers Caucus. “I hope you f—ing die. I hope your f—ing family dies. I hope everybody in your f—ing staff dies, you f—ing piece of f—ing s—. Traitor!”

Even National Review, in a descent almost as steep as that of the Claremont Institute, was outraged at Republicans voting for the the infrastructure bill.

Tasty tidbits

An unexpected take on Afghanistan

As for the Afghans, they assuredly suffered in the war, but they suffered more under Taliban rule. Michael O’Hanlon of the Brookings Institution figures that the war may have cost 400,000 Afghan lives over the past 20 years, but he guesstimates that U.S. activities there saved a million or more lives, a significant net positive.

Consider: Infant mortality dropped by half during the U.S. operation. Life expectancy improved by six years. Electricity consumption, a key quality of life indicator, increased by a factor of 10. Years in school increased by at least three years for men and four for women. University graduates rose from under 31,000 to almost 200,000. (Those and other indicators are available at the Brookings Afghanistan index.)

Those are a lot of lives saved and improved. Even at their most monstrous, the Taliban cannot roll back all the gains of the past 20 years. In fact, back in power, they would find a different country than the one they left: one with a substantial Western-educated elite and a population that has known peace and progress. “That’s what’s going to challenge the Taliban or anyone who comes in to take over leadership,” Shuja Rabbani, an Afghan expatriate and son of a former president, told me. “They’re going to have a very different kind of fight to put up.”

All of that is before reckoning the Big Payoff, which is not what you see but what you don’t see: For 20 years, there has been no major attack on the U.S. homeland.

For all of those reasons, I am resolutely agnostic on Biden’s withdrawal decision. Anyone who thinks the answer is obvious hasn’t thought seriously about it ….

Machen’s convincing case

This paragraph provided a possible key to a perennial frustration:

Christianity and Liberalism was widely read, and not just by religious conservatives. Indeed, several influential secular commentators wrote that Machen had made a convincing case. Walter Lippmann called the book “the best popular argument produced by either side in the current controversy.” The Nation and The New Republic published essays arguing that the fundamentalists had logic on their side when they invited the modernists to leave their denominations, for if the modernists contradicted the traditional creeds, then it would be only gentlemanly for them to withdraw and found churches of their own. “Fundamentalism,” the editor of The Nation wrote, “is undoubtedly in the main stream of Christian tradition while modernism represents a religious revolution as far-reaching as the Protestant Reformation.” These secular intellectuals had, it seemed, become so detached from religion that they imagined seventeenth-century reasoning normative for the church. Yet such was their prestige that many liberal Protestants feared that the logic of the fundamentalist position had prevailed.

I complain that secular people and mainstream media read the Bible through a fundamentalist lens before rejecting it contemptuously as absurd, or wicked, or something. That problem — the eclipse of historic Christian hermeneutics by novel Anglo-American hermeneutics — may be a century old, and may have arisen because J. Gresham Machen wrote such a very persuasive defense of fundamentalism as then understood.

I note that Christianity and Liberalism is still in print, including free PDF downloads. I’d read it but I’m expecting an emergency phone call, if you know what I mean.

History rhymes

Orthodox laity vs. Catholic theology students

I decided to ask people at the picnic whether it made any difference that Jesus rose from the dead. I began with my eighteen-year-old niece and my seventy-year-old mother. Neither had any theological education. I questioned each independently: “Does the Resurrection of Jesus make any difference?”

“Yes,” they both answered immediately.

“Why?” I asked. I remained silent as each of them struggled to articulate a response. But eventually they both arrived at the same correct answer. My niece said that the Resurrection of Christ restored the relationship between us and God, and my mother said that it opened up heaven to us. I was impressed. Every Orthodox Christian of whom I have asked this question has also given me a similar response.

This only fueled my curiosity: Why did these ordinary Orthodox Christians know the theological significance of the Resurrection of Christ—and believe it mattered—when my graduate school theology classmates seemingly did not?
